The Legal Directorate has two divisions: State Property and Statutory Instruments, and performs the following functions provided for in Article 33 of the Structural Regulations of the Ministry of Finance:
- provides legal aid for the legally conforming exercise of the powers of the Minister of Finance;
- supports the Minister of Finance and the directorates from the specialized administration of the Ministry of Finance in legal issues in the area of public finance;
- participates in the drawing-up of draft pieces of legislation connected to the preparation, performance and reporting of the state budget;
- provides opinions and participates in the preparation of draft pieces of legislation and agreements related to the assumption and management of government and government guaranteed debt;
- supports the Minister and the directorates from the specialized administration of the Ministry of Finance in legal issues related to state policy implementation with regard to international financial organisations and foreign credit institutions;
- participates in the elaboration of draft pieces of legislation, of general and individual administrative acts and other instruments within the competence of the Minister of Finance and provides opinions in this regard;
- provides opinions on draft international agreements and draft pieces of legislation related thereto, as per its competence;
- prepares opinions in connection with the exercise of the powers of the Minister of Finance for the acquisition, management and disposition of state property;
- coordinates, analyses and renders methodical support in connection with the exercise of the powers of the Minister of Finance with regard to the involuntary expropriation of property by preparing opinions and draft legislative and non-legislative acts;
- draws up state ownership title deeds for the properties of the Bulgarian state abroad and takes note of the changes therein; creates and keeps the main register of state-owned property abroad; prepares orders for writing-off the properties of the Bulgarian state abroad; renders assistance in the settlement of the legal status of the properties and takes part in the drawing-up of interstate and intergovernmental agreements in their part referring to state property abroad;
- coordinates drafts of decisions under the Access to Public Information Law;
- takes part in the preparation of opinions on constitutional lawsuits whereunder the Minister of Finance is a concerned party which refer to public finance, state property management, international agreements or relations with international financial organisations and foreign credit institutions;
- analyses the legal aspects of the implementation of legislation in the area of public finance, state property management, etc., and proposes a refinement of the legislation.
